Welcome to Mai Journal. These Terms of Service ("Terms") govern your access to and use of the Mai Journal application and related services (together, the "App"), provided by Mai Journal ("we", "us", "our").
By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You may use the App only if:
- You are at least 13 years old (or 16 years old if you live in the European Economic Area or United Kingdom).
- You have the legal capacity to enter into a binding agreement in your jurisdiction.
- You are not barred from using the App under applicable law.
If you are under the age of majority in your jurisdiction but old enough to use the App, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
To use the App, you sign in with a Google or Apple account. You are responsible for:
- Maintaining the security of the account you use to sign in.
- All activity that occurs under your account.
- Notifying us promptly if you suspect unauthorized access to your account.
We rely on your sign-in provider (Google or Apple) to verify your identity. We are not responsible for security failures at your sign-in provider.
3. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use, and subject to these Terms.
You may not:
- Copy, modify, distribute, sell, lease, or sublicense the App.
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent expressly allowed by applicable law.
- Use the App to build a competing product or to scrape, harvest, or mine our content or data.
- Remove or alter any proprietary notices in the App.
- Use the App in violation of any law.
We may update, change, or discontinue features of the App at any time.
4. Your Content
The journal entries, goals, planner items, and other content you create in the App ("Your Content") belong to you.
To operate the App, you grant us a limited, worldwide, royalty-free license to store, process, transmit, back up, and display Your Content solely for the purpose of providing the App to you. We do not use Your Content for advertising, AI training, or any purpose other than operating the App on your behalf. This license ends when Your Content is deleted from our systems (subject to the retention rules in our Privacy Policy).
You are responsible for Your Content. You confirm that Your Content:
- Belongs to you or you have the right to use it.
- Does not violate any law or the rights of any third party.
5. Acceptable Use
You agree not to use the App to:
- Violate any law or the rights of any other person.
- Harass, threaten, or harm any person.
- Upload or transmit malware, viruses, or any malicious code.
- Interfere with, disrupt, or overload the App or its underlying infrastructure.
- Attempt to gain unauthorized access to any part of the App, other user accounts, or any related systems.
- Probe, scan, or test the vulnerability of the App without our written permission.
- Use the App to send unsolicited communications, spam, or chain messages.
- Impersonate another person or misrepresent your affiliation with any person.
- Use any automated means (bot, scraper, etc.) to access the App without our written permission.
We may suspend or terminate your access to the App if you violate these rules.
6. Important Health Disclaimer
Mai Journal is a self-reflection and journaling tool. It is not a medical device, medical service, or healthcare product. It is not designed, intended, or licensed to diagnose, treat, cure, mitigate, or prevent any medical, mental-health, or psychological condition.
The App, its content (including any prompts, exercises, frameworks, or educational materials), and any output generated by the App:
- Are not medical, psychological, psychiatric, or other professional advice.
- Are not a substitute for evaluation, diagnosis, or treatment by a qualified healthcare professional.
- Should not be relied upon for any decision regarding your health or well-being.
If you are experiencing a mental-health crisis, thoughts of self-harm, or thoughts of harming others, please do not use this App as your response. Contact the 988 Suicide & Crisis Lifeline (United States), your local emergency services, or a qualified mental-health professional immediately.
You agree to use the App at your own discretion and risk, and you assume full responsibility for any actions you take or do not take based on your use of the App.
7. Fees
The App is currently free to use. We may introduce optional paid features, subscriptions, or in-app purchases in the future. If we do, any additional terms applicable to those paid features will be presented to you in the App before you purchase, and your purchase will be subject to the payment terms of the platform you bought it through (such as the Microsoft Store, Apple App Store, or Google Play).
8. Availability and Changes
We work to keep the App available, but we do not guarantee that it will be uninterrupted, error-free, or always accessible. The App may be unavailable from time to time for maintenance, updates, or reasons beyond our control.
We may add, remove, or modify features of the App at any time. We may also discontinue the App. If we discontinue the App, we will use reasonable efforts to give you advance notice and a way to export Your Content.
9. Third-Party Services
The App relies on third-party services such as Google Firebase, Google Sign-In, and Sign in with Apple. Your use of those services through the App is also subject to the terms and policies of those providers. We are not responsible for the acts, omissions, or policies of third-party providers.
10. Disclaimers
The App is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted operation.
We do not warrant that the App will meet your requirements, that defects will be corrected, or that the App will be free from viruses or harmful components.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the disclaimers above apply to the maximum extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will Mai Journal be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total cumulative liability to you for any claim arising out of or related to the App or these Terms is limited to the greater of (a) the amount you paid us for the App in the twelve (12) months before the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow the limitation of liability for incidental or consequential damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Mai Journal and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the App, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.
13. Termination
You may stop using the App at any time. You may delete your account through the App's settings, which will begin the deletion process described in our Privacy Policy.
We may suspend or terminate your access to the App at any time if you violate these Terms or if we reasonably believe your use of the App may cause harm to other users, to us, or to any third party.
Sections that by their nature should survive termination (including Your Content, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If a change is material, we will notify you through the App or by emailing the address associated with your account. Your continued use of the App after the change takes effect constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Santa Clara County, California will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the App, except that either party may seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
